
03 Jan The Superintendency maintains the threshold that must be considered to inform or notify transactions through merger control procedures in 2020
The Superintendent of Industry and Commerce issued Resolution No. 76544 of 27 December, 2019, through which it fixed the operating income and total assets that must be considered to inform or notify transactions through merger control procedures in 2020. As with the resolution that fixed the threshold that was applicable in 2019 (Resolution No. 93503 of 2018), the Superintendency of Industry and Commerce (SIC) decided to maintain the same thresholds for merger control procedures that will be carried out in 2020.
The threshold to determine which transactions must be informed or notified is fixed at 60,000 monthly legal minimum wages. In Colombian pesos, this figure is equivalent to COP52,668,180,000, which is in turn equivalent to approximately USD16,161,634.20 (at current exchange rates). The SIC therefore maintained the same thresholds that were applicable in 2017, 2018 and 2019 for merger control procedures.
